Catholic Foundation, Diocese of St. Augustine's Bequest Language

An excellent way for you to support Catholic Foundation, Diocese of St. Augustine's mission is to leave us a bequest in your will or living trust. One significant benefit of making a gift by bequest is that it allows you to continue to use the property you will leave to charity during your life. Another benefit is that you are able to leave a lasting legacy.

Types of Bequests


There are a number of ways you can make a bequest to Catholic Foundation, Diocese of St. Augustine.

Specific Bequest. A specific bequest involves making a gift of a specific asset such as real estate, a car, other property or a gift for a specific dollar amount. For example, you may wish to leave your home or $10,000 to Catholic Foundation, Diocese of St. Augustine.

Percentage Bequest. Another kind of specific bequest involves leaving a specific percentage of your overall estate to charity. For example, you may wish to leave 10% of your estate to Catholic Foundation, Diocese of St. Augustine.

Residual Bequest. A residual bequest is made from the balance of an estate after the will or trust has given away each of the specific bequests. A common residual bequest involves leaving a percentage of the residue of the estate to charity. For example, you may wish to leave 30% of the residue of your estate to Catholic Foundation, Diocese of St. Augustine.

Contingent Bequest. A contingent bequest is made to charity only if the purpose of the primary bequest cannot be met. For example, you could leave specific property, such as a vacation home, to a relative, but the bequest language could provide that if the relative is not alive at the time of your death, the vacation home will go to Catholic Foundation, Diocese of St. Augustine.

Bequest Benefits


A bequest is generally a revocable gift, which means it can be changed or modified at any time. You can choose to designate that a bequest be used for a general or specific purpose so you have the peace of mind knowing that your gift will be used as intended. Bequests are exempt from federal estate taxes. If you have a taxable estate, the estate tax charitable deduction may offset or eliminate estate taxes, resulting in a larger inheritance for your heirs.

Bequest Language


In order to make a bequest, you should speak with your attorney. Your attorney can help you include a bequest to Catholic Foundation, Diocese of St. Augustine in your estate plan which can be made in perpetuity to a specific fund benefitting your parish, Catholic school or favorite ministry. You may also leave a cash gift to any of these entities. We have provided some basic bequest language to assist you and your attorney.

The following is suggested language for use in your will, trust or other estate planning documents. Your gift plan is very important and the Catholic Foundation is ready to assist you or your professional advisors should you need further information. You are encouraged to register your gift intentions with the Foundation by completing a legacy society registration and becoming a valued member of the Order of Augustin Verot. Details of your gift will be kept confidentially on file. You may also allow us to acknowledge you publicly as a future benefactor or remain anonymous.

NOTE: All the provisions below may be made directly to the Diocese of St. Augustine or "restricted" for the benefit of a Diocesan parish, school and/or ministry:

For a gift provision in a will or trust:

1) for a perpetual gift to the restricted fund of a beneficiary:

I devise (an amount equal in value to _____%) of my entire estate OR (the sum of $_______) passing under this Will (or trust) to Erik T. Pohlmeier as Bishop of the Diocese of St. Augustine, or his successor in office, at 11625 Old St. Augustine Rd., Jacksonville, Florida 32258, for The Catholic Foundation of the Diocese of St. Augustine, the income from said gift to be for the exclusive use and benefit of __________________NAME & ADDRESS OF PARISH, SCHOOL OR MINISTRY

2) for an outright cash gift made directly to a beneficiary:

I devise (the sum of $_______) OR (an amount equal in value to ____% of my entire estate passing under this Will) to Erik T. Pohlmeier as Bishop of the Diocese of St. Augustine, or his successor in office, at 11625 Old St. Augustine Rd., Jacksonville, Florida 32258, for the use and benefit of __________________NAME & ADDRESS OF PARISH, SCHOOL OR MINISTRY (gift goes directly to entity when received)

For a beneficiary designation in an insurance policy, retirement plan or charitable remainder trust:

1) Designation of Beneficiaries page:

Erik T. Pohlmeier, Bishop of the Diocese of St. Augustine or his successor

2) Beneficiary Information page(s) for gift to the endowment fund for the Catholic Foundation or restricted to a parish, school or ministry's fund at the Foundation:

Erik T. Pohlmeier as Bishop of the Diocese of St. Augustine, or his successor, for The Catholic Foundation of the Diocese of St. Augustine [FBO ________________ fund if appropriate] in perpetuity.

3) Beneficiary Information page(s) for a cash gift to the Diocese of St. Augustine or restricted to a parish, school or ministry:

If your gift is at least $25,000, you may wish to create a named restricted fund by including the following language.

"The property comprising this gift may, for investment purposes, be merged with any of the Catholic Foundation's investment assets. However, the gift shall be designated in the foundation's books as the ________________ [name] Fund, shall always be so designated, and the income from there, but not the principal, shall be used for ________________ [stated purpose] of the Catholic Foundation, Diocese of St. Augustine, Florida."

It is requested that you contact the Catholic Foundation prior to such arrangements to ensure the beneficiary entity is willing and capable of accepting the gift for your desired purposes in perpetuity.

Restricted Bequests


If you are making a restricted bequest, we recommend that your attorney include the following provision to give Catholic Foundation, Diocese of St. Augustine flexibility should it no longer be possible for Catholic Foundation, Diocese of St. Augustine to use your gift as you originally intended:

If, in the judgment of the Board of Directors of Catholic Foundation, Diocese of St. Augustine, it shall become impossible for Catholic Foundation, Diocese of St. Augustine to use this bequest to accomplish the specific purposes of this bequest, Catholic Foundation, Diocese of St. Augustine may use the income and principal of this gift for such purpose or purposes as the Board determines is most closely related to the restricted purpose of my bequest.
